Prosecutors file motion against Chris Brown

LOS ANGELES, Calif.–Prosecutors filed a motion today asking that Chris Brown be found in violation of his probation for failing to complete 180 days of community labor, alleging that in some instances the singer was actually in a different state or on a plane to Cancun when he claimed to be carrying out his sentence.

Brown, 23, has been on probation since June 2009, when he pleaded guilty to assaulting his girlfriend, singer Rihanna, inside a rented car in the Hancock Park area.

In a 19-page motion, prosecutors cited various discrepancies in reports about Brown’s community labor work in Virginia, where he was authorized by the court to complete that portion of his sentence.

According to prosecutors, probation officers reported in October 2011 that Brown had completed 581 hours of community labor. The following month, the Richmond Police Department reported that Brown had completed 103 days–or 824 hours–of community labor. But in February 2012, the Interstate Commission for Adult Offender Supervision Office reported that Brown had completed 701 hours.

Prosecutors said they made repeated requests for documentation of Brown’s community labor hours, but have not found any corroboration of the numbers.

“In fact, evidence shows that although Virginia Probation accepted supervision of defendant, no one from that department every approved, scheduled, supervised, monitored or verified any of the community labor reported to this court,” according to the prosecution motion.

“Representations made by the Richmond Police Department regarding supervision, completion, documentation and reporting of the defendant’s labor are inconsistent, unreliable and cannot be attributed to any source.

“Claims that the defendant completed in excess of 500 hours of community labor at Tappahannock Children’s Center cannot be verified or documented. In addition, claims that the defendant cleaned, stripped and waxed floors at that location have been credibly contradicted.”

Prosecutors noted in the court papers that on some dates that Brown was reported to be performing community labor, he wasn’t even in Virginia.

In one case, Brown was reported by Virginia officials to have performed eight hours of community labor on Oct. 23, 2010, in Richmond, but he actually spent that day hosting the Eunice Kennedy Shriver Challenge in Washington, D.C., prosecutors contend.

On March 15, 2012, Richmond officials said Brown spend four hours picking up trash between 10 a.m. and 6 p.m., but flight records showed that Brown was aboard a private jet that left Richmond bound for Cancun at 4 p.m., according to prosecutors.

They also contended that work Brown allegedly performed at the Tappahannock Children’s Center in Virginia was arranged by Brown’s mother, the former director of the facility. Although he claimed to have been cleaning floors at the center after-hours, there was no evidence Brown performed any of
the work, and the center’s regular floor-cleaning contractor stated he had never seen the singer there, and no one else had done any floor cleaning, according to the court documents.

In their court papers, prosecutors asked that Brown be required to perform all of his community labor in Los Angeles County under the supervision of the probation department.

On June 22, 2009, Brown pleaded guilty to assault by means likely to produce great bodily injury. He admitted that he assaulted Rihanna during an argument that began around 12:30 a.m. Feb. 8, 2009, while the singers were in a rented Lamborghini in the Hancock Park area. Brown issued a videotaped apology

He was sentenced to five years probation, a yearlong domestic violence program that he has already completed and the 180 days of community labor.

In an August interview with Oprah, Rihanna said she has forgiven Brown.

The two have since reunited.

Brown is due in court tomorrow for a progress report hearing.

Prosecutors noted in their court papers that Brown has also committed a number of other potential probation violations, most recently an alleged fight with singer Frank Ocean at a West Hollywood recording studio. Brown and two of his companions allegedly punched Ocean in a dispute over a parking space.

Brown also tested positive for marijuana last summer, failed to receive a travel permit from his probation officer before taking a court-approved trip to Paris in July and allegedly angrily stole a phone from a fan who took pictures of the singer in Miami, prosecutors contend.
