Los Angeles County prosecutors declined this week to file a felony case against Trey Songz, who was arrested last month on suspicion of domestic violence, instead referring the matter to the Los Angeles City Attorney’s Office for consideration of a misdemeanor case against the rapper.

Frank Mateljan with the City Attorney’s Office said the matter is under review and no filing decision has been made yet.

The 33-year-old rapper — whose real name is Tremaine Neverson — was arrested around 6:30 a.m. March 19 by officers from the Los Angeles Police Department’s Hollywood Division. He was released on $50,000 bond about two hours later, jail records show.

TMZ.com reported that the singer’s attorney, Shawn Holley, gave numerous witness statements to police that contradicted Andrea Buera’s account of what happened during the NBA All-Star Weekend in February.

Buera, 27, held a news conference with attorney Lisa Bloom in Woodland Hills last month, alleging that the rapper attacked her while they were attending an after-party in Hollywood.

“I was attending an after-party when Trey began yelling at me, choking me, punching me and ultimately he knocked me to the ground,” she said. “While I was on the ground, he continued punching me. And he did not stop until his security guard pulled him off of me.”

Buera obtained a restraining order against the singer last month, alleging in court papers that Songz became upset with her at the Feb. 18 party, which was held at a home he was renting, because she was talking to another man.

The rapper also took to Twitter last month to make his first public comments about the accusations.

“For weeks my lawyers and (management) have asked me not to comment on this and I initially agreed but this morning I feel that my (family) and fans especially the youth need to hear from me,” he wrote. “I am being lied on and falsely accused for someone’s personal gain. I won’t be speaking too much more on this but would like to thank you for all the prayers and support.”
